The Council finds that granting a conditional use permit to allow the non-rental <br /> guest apartment will not be detrimental to the health, safety or general welfare of <br /> the public, would not adversely a.ffect light, air nor pose a fire hazard or other <br /> danger to neighboring properties, nor will its use depreciate surrounding property <br /> values and that the proposed level of use of the properry will be in keeping with <br /> the intent and objectives of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> 5. The City Council has considered this application including the fmdings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> � Based upon one or more of the above findings, the.Orono City Council hereby <br /> grants a conditional use permit per Municipal Zoning Code Section 10.24, Subdivision 3 to the <br /> current owners and applicants, Peter W. T. and Jennifer M. Lowlier, to permit a non-rental <br /> apartznsnt Wit.�1lII tI1�Lr residence located at 2684 Lydiard Avenue, subject to the following <br /> conditions: <br /> 1. This conditional use permit is granted to applicants as current owners and shall <br /> be in effect while parents continue to reside in apartment. At the time the pazents <br /> no longer use the apartment, applicant shall apply for a building permit to make <br /> the necessary alterations to structure so that the kitchen area within apartment unit <br /> is removed. <br /> 2.
