Folland <br /> August 21, 1979 � � <br /> Page 3 <br /> Orono Orchard Road is a City street and we will not allow any <br /> construction on that street unless County Road 15 is first <br /> opened for traffic and is kept open during the time when there <br /> is any co�struction on Oro� Orchard Road. <br /> In the event that the City does allow you to proceed with con- <br /> struction on Orono Orchard Road if County Road 15 is open, the <br /> City will do so only if it can receive adequate assurances in <br /> writing that the work, if commenced this fall on Orono Orchard <br /> Road, will be completed during this construction season. As we <br /> know, the general scope of construction on Orono Orchard Road <br /> consists of the cutting of a pipeline trench through the middle <br /> . of the road, the removal of the blacktop and the gravel therein, <br /> � placement of the pipe, back filling and compaction of the gravel, <br /> and then resurfacing the disturbed area with asphalt, with an � <br /> overlay of asphalt over the entire road to be completed either <br /> this fall or next spring. In the event that construction were <br /> commenced and were impossible to ade�uately close the trench <br /> and resurface the disturbed area, then that road will be <br /> entirely inadequate during the entire winter and early spring <br /> season for passage of vehicular traffic, including the neces- <br /> sary police, fire and ambulance services . Therefore, .the City <br /> - of Orono will reserve to itself the right not to allow any <br /> construction on Orono Orchard Road unless at the time construc- <br /> tion is proposed to commence, it believes that the contractor <br /> can complete the �vork as noted above. In the event that the <br /> City has doubts that the work can be completed as noted, then <br /> the City may not allow that work to proceed or the City may <br /> -allow the work to proceed only if the MWCC undertakes in writing <br /> first to complete restoration as noted above or else the MWCC <br /> will be responsible for contracting with the City or some other <br /> agreed upon company to keep the road open in the winter and to <br /> pay any of the extraordinary costs incurred by the City because <br /> � of the inadequacy of the partically restored road. <br /> Regardlessof whether or not the City allows the construction to <br /> proceed on Orono Orchard Road, prior to the end of the construction <br /> season, the MWCC must complete restoration of those two areas on <br /> Orono Orchard Road�that have presently been distrubed by the <br /> j acking of the pipe under the road. <br /> In regard to overlaying of Orono Orchard Road, because of the <br /> delays in construction to date, the City would be willing to <br /> allow the overlaying of the road next spring as long as the <br /> P'lWCC signs a written contract to that effect.
