Folland August 21, 1979 � � Page 3 Orono Orchard Road is a City street and we will not allow any construction on that street unless County Road 15 is first opened for traffic and is kept open during the time when there is any co�struction on Oro� Orchard Road. In the event that the City does allow you to proceed with con- struction on Orono Orchard Road if County Road 15 is open, the City will do so only if it can receive adequate assurances in writing that the work, if commenced this fall on Orono Orchard Road, will be completed during this construction season. As we know, the general scope of construction on Orono Orchard Road consists of the cutting of a pipeline trench through the middle . of the road, the removal of the blacktop and the gravel therein, � placement of the pipe, back filling and compaction of the gravel, and then resurfacing the disturbed area with asphalt, with an � overlay of asphalt over the entire road to be completed either this fall or next spring. In the event that construction were commenced and were impossible to ade�uately close the trench and resurface the disturbed area, then that road will be entirely inadequate during the entire winter and early spring season for passage of vehicular traffic, including the neces- sary police, fire and ambulance services . Therefore, .the City - of Orono will reserve to itself the right not to allow any construction on Orono Orchard Road unless at the time construc- tion is proposed to commence, it believes that the contractor can complete the �vork as noted above. In the event that the City has doubts that the work can be completed as noted, then the City may not allow that work to proceed or the City may -allow the work to proceed only if the MWCC undertakes in writing first to complete restoration as noted above or else the MWCC will be responsible for contracting with the City or some other agreed upon company to keep the road open in the winter and to pay any of the extraordinary costs incurred by the City because � of the inadequacy of the partically restored road. Regardlessof whether or not the City allows the construction to proceed on Orono Orchard Road, prior to the end of the construction season, the MWCC must complete restoration of those two areas on Orono Orchard Road�that have presently been distrubed by the j acking of the pipe under the road. In regard to overlaying of Orono Orchard Road, because of the delays in construction to date, the City would be willing to allow the overlaying of the road next spring as long as the P'lWCC signs a written contract to that effect.
