The specific use of the <br /> guest house had not been shown and mer�bers were <br /> not convinced the property would not be sold. <br /> Approval of this application would be an onen <br /> invitation to a violation. <br /> Staff Recommendations: Staff concurs with the <br /> minority opinion and would recomr,iend against <br /> approval of the conditional use permit for Richard <br /> Oliver to reconstruct a guest house on the following <br /> findings : <br /> 1. The guest house does not meet all the regular <br /> lot requireraents. The structure meets all <br /> the setbacks but not the area requirement. <br /> The total lot would have to be at least one <br /> acre, 43,560 sq. ft. Total area of Oliver <br /> property is approximately 22, 300 sq. ft. <br /> 2. The procedure mechanics are nonexistent for <br /> enforcing such conditional use pern.►its when <br /> a property is sold. <br /> 3. City does not charge an additional sewer unit <br /> for a guest house with separate kitchen and <br /> bathroom facilities. Satff recommends a <br /> review of current policy. <br /> Council Meeting - June 12 , 1979 <br /> Mr. Oliver was not present. � <br /> Pau�us riov�d, Butler seconded, to deny the <br /> conditional use permit for Richard Oliver, <br /> 3898 Cherry Avenue, per the following staff <br /> recomnendations : that the lot area and setbacks <br /> were too small to meet the intent of Section 34 . 027; <br /> that no sewer unit had ever been charged or made <br /> available for a second dwelling on the lot; and <br /> that all past City records indicated that the <br /> garage was an accessory storac�e building only. <br /> Mdtion, Ayes (4) - Nays (0) . <br />
