P4otion, Ayes (5) - <br /> Nays (0) . <br /> Dick Benson, City Administrator, presented the City AR�"Y CORPS OF ENGINEERS <br /> Council with a r,ierto concerning the Army Corps of Clean Water Permits <br /> Engineers regarding clean water act perr►its , dated <br /> P4ay 4, 1979 , which states : <br /> Everyone is probably aware that the U.S. 8th Circuit <br /> Court ruled against the Corps of Engineer' s authority � <br /> to regulate usage of the Lake by rejecting their <br /> appeal. <br /> The Court did rule the Corps would retain jurisdiction <br /> over dan construction and placenent of riprap. If <br /> the State Department of Pdatural Resources ' peri*tit <br /> prograri is approved by the U.S.E.P.A. , the State <br /> would then have prir.�►e authority over riprapping and <br /> we would eliminate costly time-consuming oaper work <br /> and frustrations of more government. <br /> I am contacting the DPJR to have the� work with us on <br /> this and possibl�. have sormeone at our Council meeting <br /> Tuesday evening. <br />
