This action <br /> should be noted in the recorii of the District' s public hearing <br /> to be held on January 17, 1979. - <br /> The City attorney and city staff inet with you, the LMCD attorney, <br /> _ and Mr. Wittig' s attorney on January 2, 1979. A tentative <br /> �agreement was discussed. At- that time a scale plan was promised . <br /> to the LMCD and to the City prior to the January 9, 1979 Council <br /> Meeting. The plan was not provided to the city before that <br /> meeting and has not yet been provided to the City. <br /> The City Council was aware that the LMCD would lzke City comments <br /> to be entered into the record of the LMCD public hearing. Consequently, <br /> the Council acted by making the following statements : <br /> l. The City has insufficient infor�ation to base even a <br /> conceptual review of Wittig' s proposal. <br /> 2, Wittig has been unresponsive according to the Council' s <br /> understanding of the agreement reached by staff. <br />
