Goodwin and Heather D. Goodwin, a married <br /> couple, are the owners (hereinafter "the Owners") of the property located at 565 Leaf Street <br /> within the City of Orono (hereinafter the "City") and legally described as: Lot 3, Block 1, Fox <br /> Hollow, Hennepin County Minnesota (hereinafter the"Property"); and <br /> WHEREAS, the Owners have made application to the City of Orono for a <br /> variance from Orono Municipal Zoning Code Section 78-1405 to allow construction of a fence 8 <br /> feet in height (hereinafter the "Screening Fence") where 6 feet is the maximum fence height; <br /> and <br /> WHEREAS, after due published notice and mailed notice in accordance <br /> with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the <br /> Orono Planning Commission on February 18, 2014 at which times all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File number 14-3648. <br /> 2. The Property is located in the LR-1A One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 2.0 acres and a minimum lot width <br /> of 200'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> February 18, 2014 and voted 5 in favor and 0 opposed on a motion to approve <br /> the fence height variance. The Planning Commission finds that the following <br /> factors support the granting of the requested variances: <br /> a. The Property contains 87,122 square feet in area and conforms to the 2 acre <br /> minimum lot size of the LR-1A district. <br /> b. The Owners have proposed an 8-foot high, solid panel PVC privacy fence. <br /> Page 1 of 4 <br />
