Summary <br /> While donation of the land for specified public park <br /> purposes implies the need for public access , the will <br /> clearly seeks to place severe limitations on the extent <br /> of such access in order to maintain the land north of <br /> County Road 51 in its "approximate natural state" as <br /> a wildlife preserve, and the land north of County Road 51 <br /> . as a memorial park to be devoted and operated as an <br /> "arboretum for flowers , shrubs and trees" , and for <br /> "general display garden purposes". The specific <br /> exclusion of uses of the land for picnics , camping, <br /> boat launchings or any other "uses incompatible with <br /> that of a general display garden area" as well as the <br /> specific reference to plantings to be made east of the <br /> dwelling house extending east to the Webster (Raymond) <br /> property line clearly indicates that Mrs . Hoppe in her <br /> wi11 envisioned a modest public access to land that wouid <br /> be more or less preserved in its natural state, in <br /> harmony with its surroundings , and pleasing to her <br /> immediate neighbors . <br /> In the event that her interit �o� the �.and to be le�t <br /> more or less in its natural state was unacceptable to <br /> the Park Reserve Di.strict, MxS. Hoppe provided in her <br /> will that the executors shall cause a charitable <br /> corporation to be organized for the same stated purposes . <br /> II. Negative Environmental Impact <br /> It has not been demonstrated to the residents that the <br /> environmental impact o� the project will not be adverse <br /> in terms of i.ts ef�ects on w�.ldlife, land and water as <br /> we11 as the health, safety and wel�are of the surrounding <br /> residents with respect to the above as well as the specific <br /> effects on residential property values, of litter, noise <br /> and safety from addi,tional traffic and people in the area, <br /> additional local law enforcement costs, potential future <br /> need of widening County Road 51, and the aesthetic impact <br /> on the general sense of we11 being of the residents of the <br /> community. <br />
