Because Northwest Cinema Theatre Corporation NAVARRE DRIVE-IN has represented to the City that it seeks to sell THEATRE the property and thereby to terminate the use of (Continued) this property as a theater in 1978, and therefore does not wish to construct a perimeter fence all � aroun�d the property in 1978, the City of Orono has agreed to the above modifications. Fiowever, because the City is not now requiring a fence around the entire perirneter, the City of Orono will and does reserve the right to require additional fencing in 1978, if it is found after a public hearing that the fences required by this agree�ent are not reasonably sufficient to protect the health, safety and welfare of the citizens of Orono, or the patrons attending the drive-in or the police personnel called to assist at the drive-in. I. This agreement in no way grants any continuing rights to Northwest Cinema Theatre Corporation. Attachment A - #1 Northwest Cinema Theatre Corporation first constructs a temporary fence of galvanized wire mesh, similar to those used in construction sites, which fence will start at the ground and rise 6 feet with sturdy posts on approximately 8 foot centers , cor.�►mencing at the City' s water tower fence and proceeding northerly along Blaine Avenue a distance of 200 feet set back approxiznately 15 feet from the pavement. Pdorthwest Cinema Theatre Corporation shall remove all debris from the street side of said fence. The galvanized wire mesh shall be attached to the posts at the ground level, at mid-point and at the top in such manner as to insure that the mesh cannot -be lifted from the ground sufficient to permit human passage through or under the fence. Attachrnent A - #2 Northwest Cinema Theatre Corporation first constructs a permanent wood fence with vertical pickets, 100$ opaque, which fence starts at the ground and rises at least six feet,with poles set on approximately 8 foot centers, commencing at the City' s water tower fence and proceeding northerly along Blaine Avenue a distance � of 200 feet set back approximately 15 feet from the pavement. Northwest Cinema Theater Corporation shall remove all debris from the street side of said fence. Mr. Blohm comr.iented that: I hope you will review our efforts this year in granting a theatre license for 1979. We want to control noise, crowds, ingress and egress problems. These is quite a difference in cost between materials used to construct a fence and I would want the Council to consider a lesser material cost for fencing the east and west side of the theatre.
