Because Northwest Cinema Theatre Corporation NAVARRE DRIVE-IN <br /> has represented to the City that it seeks to sell THEATRE <br /> the property and thereby to terminate the use of (Continued) <br /> this property as a theater in 1978, and therefore <br /> does not wish to construct a perimeter fence all � <br /> aroun�d the property in 1978, the City of Orono has <br /> agreed to the above modifications. Fiowever, because <br /> the City is not now requiring a fence around the <br /> entire perirneter, the City of Orono will and does <br /> reserve the right to require additional fencing <br /> in 1978, if it is found after a public hearing <br /> that the fences required by this agree�ent are <br /> not reasonably sufficient to protect the health, <br /> safety and welfare of the citizens of Orono, or <br /> the patrons attending the drive-in or the police <br /> personnel called to assist at the drive-in. <br /> I. This agreement in no way grants any continuing <br /> rights to Northwest Cinema Theatre Corporation. <br /> Attachment A - #1 <br /> Northwest Cinema Theatre Corporation first constructs <br /> a temporary fence of galvanized wire mesh, similar <br /> to those used in construction sites, which fence <br /> will start at the ground and rise 6 feet with <br /> sturdy posts on approximately 8 foot centers , <br /> cor.�►mencing at the City' s water tower fence and <br /> proceeding northerly along Blaine Avenue a distance <br /> of 200 feet set back approxiznately 15 feet from <br /> the pavement. Pdorthwest Cinema Theatre Corporation <br /> shall remove all debris from the street side of said <br /> fence. The galvanized wire mesh shall be attached <br /> to the posts at the ground level, at mid-point and <br /> at the top in such manner as to insure that the <br /> mesh cannot -be lifted from the ground sufficient <br /> to permit human passage through or under the fence. <br /> Attachrnent A - #2 <br /> Northwest Cinema Theatre Corporation first constructs <br /> a permanent wood fence with vertical pickets, 100$ <br /> opaque, which fence starts at the ground and rises at <br /> least six feet,with poles set on approximately 8 foot <br /> centers, commencing at the City' s water tower fence and <br /> proceeding northerly along Blaine Avenue a distance � <br /> of 200 feet set back approximately 15 feet from the <br /> pavement. Northwest Cinema Theater Corporation shall <br /> remove all debris from the street side of said fence. <br /> Mr. Blohm comr.iented that: I hope you will review <br /> our efforts this year in granting a theatre license for <br /> 1979. We want to control noise, crowds, ingress and <br /> egress problems. These is quite a difference in cost <br /> between materials used to construct a fence and I would <br /> want the Council to consider a lesser material cost <br /> for fencing the east and west side of the theatre.
