� Rr:GULAR MEETING OF THE ORONO COUNCIL, riAY 11, 1978 Page 10 <br /> 7 : 17 P.r4. - Mr. Randall Blohm and P'Ir. Erving NAVARRE DRIVE-IN <br /> Braverman present. THEATRE FENCE <br /> r�r. Bruce Malkerson, City Attorney, reviewed the <br /> past history of the Drive-In Theatre noting that <br /> all information is included in the record. Mr. <br /> Malkerson discussed the recent appearance before <br /> the courts on the temporary restraining order and <br /> the pleadings by the applicant not to construct <br /> a fence. The theatre management have agreed to <br /> Resolution #898, except for paragraph #�24. They <br /> are here this evening to make us an offer to <br /> modify paragraph #24. We must remember that this <br /> is a matter of litigation, we are not in executive <br /> session at this time but the theatre management <br /> have requested to be heard. <br /> Mayor Van Nest: We want to accomplish: <br /> l. Crowd control <br /> ? Bevelop noise barrier <br /> 3. Light barrier <br /> 4. Visual barrier <br /> 5. Opaque fencing, six-feet high. <br /> We met on the site last Wednesday with Mr. Braverman, <br /> Mr. Blohi*,�,Mr. Psalkerson, P�Ir. Benson, Mr. Olson, and <br /> Mr. Gerhardson to determine where a fence would be <br /> appropriate. Mayor Van Nest presented a plat map <br /> of the area showing where the fence is intended to <br /> be constructed. <br /> Mr. Blohm reviewed it and agreed to it except for <br /> a wood cedar fence along Blaine Avenue. <br /> Councilmember Massengale: Does the 200 ft. wood <br /> fence along Blaine Avenue run past the last house? <br /> Mayor Van Nest: Yes, it does. <br /> Bruce F�alkerson: I met with the theatre people <br /> today and they have submitted a proposed amendment <br /> with modifications to Resolution #898, which states: <br /> Paragraph 24 of Resolution 898 is hereby amended <br /> as follows: <br /> 24. Prior to any operations of the theatre in 1978, <br /> Northwest Cinema Theatre Corporation shall comply <br /> with the following conditions: <br /> A. (See attachment) <br /> B. Northwest Ciner.ta shall construct a temporary <br /> fence of galvinized wire mesh, similar to those <br /> used in construction sites, which wire mesh will <br /> start at the ground level and continue to a height <br /> of at least six feet, which fence must have sturdy <br /> (Continued) <br />
