On thc .'�'urth Sh�rc or Lck.e .'�:i1:nf�;��r,�a F "' t - - , � - : ��::� f� �=� .__ ._ _ I April 4, 1978 Long Lake City Council � Long Lake I�innesota 55356 Dear Mayor and Councilmembers: � After reviewing the material which I have enclosed for your review and in reviewing our City Attorney' s opinion of February 7, 1969 and March 16 , 1978, and in view of the results of the last dispute whereas the City of Long Lake has assumed the obligation of paying all utility and maintenance costs, the Orono City Council' s c3ecision based upon this data does not agree to assume the responsi- bility of paying utility or maintenance costs on the booster station. Your minu-tes of February 16, 1978, refer to the Orono pumping station on Orono property, but the contract initiated on December 13, 1967, states that the pumping station is located in Long Lake_ We feel that it is very difficul.t to justify a water rate reduction to a user based upon shifting rtaintenance and utility costs from one _ City to another, when in fact, the original rates were determined - by those projected costs_ _ - ' I also received last week a letter dated January 16, 1978, to your Public Works Director, Mr. Marv Wersner, from Mr_ Lyle Swanson_ � ?ir. Swanson and I discussed this r.tatter of increased water c3emand for the Orono School system when watering their lawns last su��uner. jae determined at that time that it was apparent that the booster punps were pumping as designed (according to Mr. Swanson in his letter of January 16, 1978) and that the school was now using r.�ore water on a demand basis at certain times than was originally planned. . If this is the case, it is obvious to rae th at the City of Long Lake and Orono shall not be responsible for assuming costs to furnish more water to the schools on a demand basis than was originally planned. This situation certainiy does not apply to Section 2. 19 of the agreement. If, in fact, the Orono School does require more water than what the engineers, Mills Engineering Company, had originally �esigned the booster station for, then we should arrange a meeting with tne school, the engineers, and the I,ong Lake and Orono City representaLives to discuss this matter further.
