REGULAR P�IEETING OF THE ORONO COUNCIL, r2ARCH 30 , 1978 Page 6 tdr. Alan Olson, City Planner, entered into the record SdAPIAi]CES the following information concerning variances for 1565 Orchard Beach pl, 1565 Orchard Beach Place, Arthur Heintz dated P7arch 16 , #�345 1978, which states: Arthur Heintz The City Council adopted a resolution denying variances. and instructed staff to inspect and review garage as hazardous building/non-conforming use. Neighbor present said he would send a letter of cor►plaint with several neighborhood signatures. Staff - P�arch 24 , 1978 The City has received a petition from three neighbors complaining of the garage on this property and requesting City action to abate a nuisance. On March 22, 1978 , the Building & Zoning Department inspected the building and made findings consistent with the neighbors ' cor:unents. Staff will proceed with the . requirements of P�innesota Statutes 463. 15 and present inforr.lation for your attention at the next meeting. Council P4eeting - March 30 , 1978 I�Ir. Olson also comr_►ented that all data has not been reviewed. Mr. Heintz reviewed again the past history of the lot in question and displayed pictures of the lot where it was habited and contained a cabin and dock. Mr. Heintz requested permission to construct a dock on the property stating that he has had an opportunity to sell the property for approximately $7, 000. Mayor Van Nest commented that a dock is an accessory use structure; there is no home on the lot. We have to know when a dock, if any, was on the property. It appears that there are two__ issues here: 1. Hazardous building on lot (garage) 2. Dock - legal non-conforming use status. Mr. Heintz commented that rir. Hooper, 1530 Orchard Beach Place, has housed some of his personal material in the garage. Massengale moved, Butler seconded, to table the above requests until the next meeting to give staff time to review. Motion, Ayes (3) - Nays (0) .
