Complaints ensued after the theatre (Continued) <br /> �pening causing a special public hearing to he <br /> held May 24 , 1977 and thereafter, a special Council , <br /> meeting held tlay 26 , 1977 where Resolution #�790 ���as <br /> adopted. An additional public hearing was held on <br /> June 13, 1977, when Resolution #790 �aas extended. <br /> A third public hearing was held October 24 , 1977 <br /> at the close of the season. <br /> Throughout these meetings many of the same complaints <br /> were heard regarding control of patrons and control <br /> of access. At the last meeting, the theatre <br /> owners indicated a possible change in land use to <br /> a residential development. No specific action was <br /> directed at that time due to the possibility of <br /> the theatre not reonening. <br /> Since last fall, the City staff has had no further� <br /> contact from the property owners regarding any change <br /> in the land use. The theatre license application <br /> would tend to indicate that the other plans have <br /> been set aside. <br /> If the theatre is _to be relicensed, the lists of <br /> previous requirer.►ents speak for themselves. The <br /> one physical requirement that has never been met <br /> is that of fencing the perir:leter for control both <br /> during the shows and when the area is closed. <br /> Documents in the record show that the Citv has <br /> been requesting a fence since at least 1970. <br /> The Council may wish to hold a public hearing, to <br /> issue the license for a temporary tir.ie to thereafter <br /> review the operation, or to withhold issuance until <br /> any -required conditions riight be accomplished. " <br /> �ierlo fron Poli ce Chie� .*iel Kil�o to Dick Benson, <br /> City Administrator, dated Februarv 16, 1978 , states: <br /> "If the Plavarre Drive-In Theatre is to be relicensed, <br /> the previous conditions set out in Resolution #790 <br /> should be continued. <br /> We had problems with access into the area from <br /> Northern Avenue and parking problems along Northern <br /> Avenue. The manager.ient was cooperative and it is <br /> certainly apparent that uniformed personnel and <br /> field men are needed to control patrons. <br /> The problem still existing, therefore, is fencing. <br /> The mini-bike probler.l during the day hours and <br /> unauthorized entry (which caused parking and other <br /> problems) can only be controlled by an adequate fence.
