MN �SS391 <br /> T[�[rHON[ 612 -473-7326 ^ � �Z ' �3 <br /> F�� ,�_ - <br /> DATE: February 17, 197�3 \/�LL;�,�',t G� Crc��`�� <br /> T0 : Orono City Council and <br /> Owners of Lots in Walters-Port Subdivision <br /> RE: Legzlity and Enforceability. of Certain Restrictive <br /> Cover.an�s Affecting Lot Owners in t�'alters-Port Subdivision <br /> I have examined the contents of a document recorded in Book <br /> 2290 of Deeds, page 27, as docu�nEnt number 3275862, jn the <br /> office of the County Recorder, in and fo�r Hennepin County, <br /> which contains various restrictive covenan�s affecting the <br /> owners of Iots in Walters-Port Subdivision, and various deeds <br /> of conveyance and original certificates of ti�le on file for <br /> various present owners of said lots. <br /> The covenants in said document number 327.5862 create certain <br /> rights and obligations running to and between the owners of <br /> Walters-Port lots, spec�Pically with reference to various <br /> Outlots which provide access to insid e lots and a harbor and <br /> channel to be used by lot owners for access to Lake Minnetonka. <br /> Additionally, the recorded document contains covenants regard- <br /> i ng the individual owners' financial responsibility concerning <br /> the maintenance, etc. of outlots which benefit each 1ot in <br /> said subdivision. - <br /> The benefits to the lots and Iot owners are obvious and the <br /> covenants are sufficiently clear to render them binding upon <br /> , all Iot owners who ,purchased their lots with actual notice of <br /> these covenants, or constructive notice, via recording. <br /> � ;.- <br /> In my opinion the covenants considered ar e Ie�ally valid and <br /> binding upon all lot owners - in Walters-Port Subdivision, and <br /> legally enforceable by and between the individuals who own <br /> these lots sub�ect to these recorded covenants. <br /> �l� � <br />
