CARLSON <br /> City Council of a swnmons received November 16, vs . <br /> 1977 concerning Donald E. Carlson, Plaintiff, CITY OF ORONO <br /> vs. City of Orono, Defendant, which states: <br /> THE S`i`'A�i'E OF IIIPJNESO`?'A TO THE ABOVE-NAPIED DEFENDANT: <br /> * YOU ARE HEREBY SUPu40NED and required to serve upon <br /> plaintiff' s attorneys an Answer to the Complaint <br /> which is herewith served upon you within twenty (20) <br /> � days after service of this Suirunons upon you, <br /> • exclusive of the date of such service. If you fail <br /> to do so, Judgment by Default will be taken against <br /> � you for the relief prayed for in the Complaint. <br /> y By: R. Plaintiff, as adult, is a resident of Hennenin <br /> County, State of P4innesota. <br /> II. That defendant by its agents or em�loyees <br /> negligently allowed a dog to be inside <br />� defendant' s Golf Club House located at <br /> defendant' s Golf Course on or about August 6 , <br />■ 1977. That said Dog at the time relevant to <br /> - this matter was lying on the floor in front of <br />� defendant' s sales counter_ Defendant had a <br /> � duty to pravide a safe, obstacle-free access <br /> � to the sales counter so that persons, and <br /> especially the plaintiff herein, when walking <br /> toward the counter would not be injured by <br /> , falling over the dog. That defendant and its <br /> - agents breached said duty. <br /> III . That as a direct result of defendant' s failure <br /> to provide a safe, obstacle-free access to the <br /> sales counter, plaintiff, without negligence <br /> • on his part, on or about August 6 , 1977, fell <br /> over a dog when approaching defendant' s sales <br /> ' counter injuring hir_Zself, becoriing disabled <br /> and unable to pursue his occupation, and <br /> incurring medical expense in being exartined <br /> and treated for said injuries.
