' <br /> i <br /> � <br /> �O' ♦O <br /> C ITY OF OR�NO <br /> RESOLUTION OF THE CITY COUNCIL <br /> �`�t,� ti�'� N O. 6 � '�'�� � <br /> kESHO� <br /> A RESOLUTION VACATING <br /> DRAINAGE AND UTILITY EASEMENT OVER <br /> PARTS OF LOTS 3 AND 4,HOLLY ACRES 2�ADDITION <br /> HENNEPIN COUNTY, MINNESOTA <br /> FILE N0. 16-3838 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, Thomas W. Clapp and Laura Z. Clapp, husband and wife, are the <br /> owners (hereinafter the "Owners") of the land described in Exhibit A situated in the County of <br /> Hennepin and State of Minnesota; and <br /> WHEREAS,the aforesaid property is subject to the following Drainage and Utility <br /> Easement described in Exhibit B: <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes and the Orono, Minnesota, City Code, the Orono Planning Cornmission held a public <br /> hearing on June 20, 2016 regarding said vacation and all interested persons were given an <br /> opportunity to be heard; and <br /> WHEREAS, on June 20, 2016 the Orono Planning Commission reviewed the <br /> application and on a vote of 5-0 recommended approval of said vacation of the drainage and utility <br /> easement; and <br /> WHEREAS, the Orono Council finds the vacation as proposed is in keeping with <br /> the public interest and in consideration of the following findings: <br /> 1. T'he easement in question was part of the original plat of Holly Acres 2nd addition. <br /> (E�chibit C) Since then, the lot lines have been adjusted. The easement will be <br /> replaced with a new easement along the north property line of the subject property, <br /> (Exhibit D). <br /> 2. Electric, gas, telephone and cable utilities have been notified of the proposed <br /> vacation. <br />
