Residential Dock.The Code does not permit an accessory structure on a property without a principal structure. <br /> Once the home is removed the accessory dock may not be re-installed at 1515 Green Trees Road. There is no <br /> way around this requirement. I would suggest that Barbara Burwell propose an amendment to the City's Code <br /> that would permit the owner of one or more lakeshore properties to place residential docks, according to the <br /> LMCD regulations, on the lakeshore of a vacant property so long as there is a principal structure on the adjacent <br /> property in common ownership. I've attached the application for a City Code amendment; the fee for this <br /> application is $700. Part of the application requirements would be that you/the applicant provide some research <br /> (from other Cities) and potential code language for a starting off point. We can discuss this further, but I know <br /> Barbara expressed concern about the timing of the demolition and the need to re-install the dock for the season <br /> so I wanted to include it in this email. <br /> 2. (Potential) Indian Burial Sites. Because there are known Indian burial sites within some of the adjacent <br /> Green Trees Road properties, we contacted the MN State Archaeologist's office for their input on this permit <br /> request to inquire about known burial sites on or near 1515 Green Trees. We received a response from Amanda <br /> Gronhovd in the State Archeologist's office. She indicated that she spoke with the Minnesota Indian Affairs <br /> Council (MIAC) about the demolition permit request for 1515 Green Trees Road. Because this site is adjacent to a <br /> recorded Indian cemetery site they felt that our issuance of the demo permit would be acceptable. However they <br /> recommend that the demo and earthmoving be monitored by them in case burials are discovered/present. She <br /> indicated that between the State Archeologists'office and the MIAC, they should be able to do the monitoring at <br /> no cost to the landowner so long as they are contacted early and include them in planning the schedule. Erosion Control Permit. We've received the signed Zoning Disclosure form, escrow funds, and signed Escrow <br /> Agreement and the Demolition Permit will be ready to be issued, however we are still waiting for information <br /> from the MCWD —either a copy of their erosion control permit, or verification from the MCWD stating a permit is <br /> not required. <br /> I understand there is a lot of information squeezed into this email.
