At the time the preliminary plat was <br /> � approved, Council suggested this access easement <br /> • be provided. <br /> � Planning Commission P4eeting - October 3 , 1977 <br /> � The I:elleys were present. Planning Commission <br /> reviewed copy of final plat which indicated <br /> * all drainage and utility easements as specifi�d <br /> by Council. The access and utility easement <br /> �along the east property line of Lot 2 was <br /> � eliminated, ho�vever. Bruce Kelley explained <br /> that they were considering some lot line <br /> � rearrangements with Earl Plant, the property <br /> owner to the east, and also the prospective <br /> � buyer of the newly platted 23 plus acres Lot 1. <br /> � The Kelleys were willing to assure the City of <br /> . a required utility easement, but rec�uested <br /> delay of definite description until an agreement <br /> a is reached by the three adjoining property <br /> owners. If the City were to demand the easement <br /> � around Lot 2, any future lot rearrangement of <br /> Lot 1 would be delayed because of the necessity <br /> � to vacate said easements before proceeding with <br /> lot rearrangement. The Kelleys ac�reed to provide <br /> • to the City a conservation easement over the <br /> • wetlands area indicated on the plat as Outlot A. <br /> � Planning Commission recommended approval of final <br /> plat subject to the developer providing all <br /> � necessary easements except for the one around Lot 2 <br /> because of the hardship as explained by the <br /> � applicant.
