The intended (Continued) <br /> �agreement was not to allow more than 95 boats <br /> � on the water for rental or rental slips or boats <br /> rented to the public. The license allows for <br /> � 95 total rental slips. _ <br /> � Discussion followed concerning the apparent <br /> change of the intent of the agreement. <br /> • <br /> • Mayor Van Nest commented that you are inserting <br /> new language that was not originally proposed. <br /> � P�Ir. Douglas: My client does not intend to keep <br /> � over 150 boats on the property, wet and dry. My <br /> client wants to continue his operation and <br /> i develop an agreement by January 1, 1978. <br /> � Mayor Van Nest: The Council wants to resolve <br /> � controls on the lagoon and allow racks provided <br /> that we establish a cap on the total number of <br /> � boats and not increase the 95 rental slips. <br /> � Mayor Van Nest continued by suggesting that the <br /> agreement be amended to allow the lagoon to <br /> • conform to the terms of the agreement. Have a <br /> • cap of 150 boats on the premises, 75 in the water, <br /> 20 rental slips in racks, and 55 other boats that <br /> � �vould be allowed,owned by Mr. Hork for sale, for <br /> rental or repair. <br /> w <br /> Ten would be allowed for gas, etc. but not for <br /> • over-night. <br /> � Mr. Hork noted that now there are 159 boats on <br /> • the property. Councilmember Butler noted that <br /> we should add language to allow the Building <br /> 1 Inspector to use resonable judgment if parts or <br /> labor are not available, allowing permission to � <br /> f, have more than ten boats for repair. <br /> i <br /> • Discussion followed concerning the total cap on � <br /> the number of boats suggesting that an agreement <br /> � could allow 75 in the water, 20 in racks, and <br /> + 55 for sale or rerit from April 15 to November 1 <br /> and ten additional boats for repairs for a period <br /> � not to exceed 30 days and that the agreement ; <br /> could be amended in the future if necessary. <br /> � <br /> Mr. Douglas commented on allowing his client to <br /> � construct racks on a temporary basis and work out <br /> . an agreement by the first of the year. <br /> (Continued) <br /> � <br /> � <br /> � <br /> � <br />
