Village Hall <br /> Orono, Minnesota <br /> � Re: Ordinance No. 193 <br /> � <br /> Dear Members of City Council and the City of Orono: <br /> • <br /> At the Special City Council Meeting called and held July 18, <br /> � 1977, following your public hearing on the agreement proposed <br /> � by and between the City of Orono and my client, Larry Hork <br /> and North Shore Drive Marina, you passed, over my objections, <br /> � Ordinance No. 193 establishing a moratorium on the granting of <br /> new or additional commercial dock and mooring areas in all of <br /> � the City of Orono, and prohibiting the granting of building <br /> permits, re-zoning applications, condition or special use <br /> � permits, and other various matters. The purpose of this letter <br /> � is to advise you with specificity as to my client' s objections <br /> with reference to said ordinance: <br /> � 1. The ordinance was passed at a Special City Council Meeting <br /> � which was not duly called and noted for that particular purpose. <br /> Special City Council Meetings of the type held by you on <br /> ! July 18, 1977, in the absence of notice and an opportunity to <br /> . be heard by members of the public are unconstitutionally void <br /> as a deprivation of due process of law, and are arbitrar.y and <br /> � capricious as evidenced by your action at that meeting. <br /> � 2. Notice of the Special City Council Meeting was not given to <br /> my client or the public giving noti.ce that any moratorium <br /> � ordinance would be considered at such Special Council Meeting. <br /> � 3.
