.
'' REGULAR T4EETING OF THE ORONO COUNCIL, MAY 23, 1977 Page 53
STEWART PERRY MATTER
(Continued)
 .
3 . The record .in this matter and the policies and
reports behind the ordinances under which you must apply,
all support the action taken by the council.
I do not know if you have had much experience in land use
litigation. This firm specializes in land use and environ-
mental law litigation. "
I suggest that you accept the city' s offer of settlement or, as.
I noted previously, the city will litigate this matter vigor-
ously at the District Court level and, if necessary, before the
Supreme Court. Moreover, the City will seek the intervention
and assistance of the Minnehaha Creek Watershed District, the
Department of Natural Resources and •the Army Corps of Engineers.
The validity of the City of Orono' s actions and regulations
relating to the preservation of the lakeshore of Minnetonka and
the watersheds adjacent thereto are of utmost importance to the
city and all the municipalities around Lake Minnetonka. Even
by offering this settlement, the City of Orono is allowing you
to develop your property in a way that no other person has been
allowed to develop his property since the enactment of these
ordinances.
I would appreciate your immediate response to this settlement
offer so that if it is a negative response we can prepare our
case and proceed immediately.
End of letter
The Liquor Store Lease was deferred until the LIQUOR STORE LEASE
meeting of June 13, 1977.
Mr. Bruce rialkerson, City Attorney, reported on BEDERWOOD PARK
the status of the Conservation Easement for the
DNR at the Stubb' s Bay Bederwood Park.

Mr. Bruce Malkerson, City Attorney, presented a SKI TONKA, INC.
 Hennepin County Municipal Court Prosecution
Summary concerning Ski Tonka, Inc, to the City
Council.
A4r. Bruce Malkerson, City Attorney, presented to CHARLES STREET VACATION
the City Council information concerning the Tract B - RLS 1067
Charles Street vacation, Tract B, RLS No. 1067.
