Hork and his attorney. They could not <br /> � agree on a reasonable boat limit. The applicant <br /> suggested site to be large enough for 300 boats. <br /> � The Council was not receptive. I��r. Hork and the <br /> attorney threatened to disregard Council directives , <br /> � and continue with proposed project. <br /> � Later during the meeting, a director from the DNR, <br /> • after completing a presentation on proposed trail <br /> uses and projected improvements, commended the <br /> � City Council for action taken on marina proposal. <br /> Expressed respect for decision by Council. <br /> • <br /> �lan Olson, Assistant Building & Zoning Adminis- <br /> � trator, is scheduled to meet with P�r. Hork at <br /> . 11: 00 A. M, on May 10, 1977, to discuss proposal <br /> and negotiations. <br /> � Alan Olson' s memo dated May 18, 1977 : <br /> � <br /> State Building Code provisions "apply to the <br /> � construction, alteration, moving, demolition, , <br /> repair and use of any building or structure <br /> � within the City" . Structure is defined as <br /> � "that which is built or constructed, an edifice of <br /> building of any kind, or any piece of work <br /> � artificially built up or composed of parts <br /> joined together in some definite manner" . <br /> � <br /> Orono Zoning Code provisions apply to "anything <br /> • constructed or erected, the use of which requires <br /> • a location on, below, or above the ground, or <br /> attached to something having a location on the <br /> ' ground" . The B-2 zone restricts outside storage <br /> structures of 15 ft. high (35. 130 (i) and requires <br /> � a side setback of 10 ft. (35. 162) , or in this <br /> applicable case, 50 ft. side setback to a <br /> � residential lot (35. 172) .
