Many area residents <br /> were on hand in favor of authorized lake access. <br /> � One adjacent neighbor opposed developed usage. <br /> Comments made that realtors have advised many <br /> � residents that they had legal use of the access. <br /> Planning Commission members were sympathetic-- <br /> � to the local request, but stressed that: <br /> • l. ' Public" use would have to be open_ to all, <br /> � not limited to local residents. <br /> 2. Ivy Lane is a legal street easement, not <br /> � public property dedicated for other usage. <br /> 3. The physical size and s lope of the property <br /> � makes development and policing difficult or <br /> impossible. <br /> � 4. The City would assume liability if development <br /> was allowed and then not adequately regulated <br /> � or policed. <br /> � 5. Similar requests from other areas of the City <br /> have been refused due to similar problems. <br /> � 6. There is currently a proposal before the City <br /> to develop a larger property on the east end <br /> � of the lake to serve the northern City residents. <br /> � Therefore, the Planning Commission unanimously <br /> • recommended denial of the petition for development <br /> of a swimming or docking access on ivy Lane and <br /> � instead recommended posting the area for fire <br /> department access only.
