Mrs. Gasch <br /> stated that she would take this matter to conciliation <br /> court if the City did not grant her her wish to be <br /> reimbursed for costs incurred to date and for monies <br /> to plant trees within the next two weeks. <br /> Henry Muhich, Building & Zoning Administrator, noted <br /> that it was very difficult in this case to interpret <br /> site line setbacks because of the topography, that <br /> the Parten property is on somewhat of a point so that <br /> it could never meet a lot setback even if one were <br /> applied for. It was noted that the City had tried <br /> to make a reasonable decision as to the location ' <br /> of this house and felt that it had done everything . <br /> in its power to do so. <br /> Mayor Van Nest commented that the City does attempt <br /> to interpret and apply the ordinances uniformly <br /> and fairly. <br /> Mayor Van Nest asked Mrs. Gasch if she felt that <br /> the requirement to plant trees in order to provide <br /> privacy was an economic burden and the City could <br /> reconsider the variance and remove the expense of <br /> Lanting the trees. <br /> Mrs. Gasch replied: . That she needed to plant the <br /> trees anyway because of her intent to remove other <br /> certain trees and to fill in certain areas along <br /> her lot line to the lake. <br /> ! Welsh moved, Butler seconded, to reconsider the <br /> variance for Mrs. Marge Gasch, 1030 Tonkawa Road. <br /> Motion, Ayes (3) - Nays (0) . <br /> Welsh moved, Butler seconded, to waive referral of <br /> the variance to the Planning Commission. Motion, <br /> Ayes (3) - Nays (0) . <br /> Welsh moved, Butler seconded, to approve variance <br /> for fence waiving condition to plant trees. Motion, <br /> Ayes (3) - Nays (0) . <br /> Mayor Van Nest moved, Butler seconded, to reject <br /> the claim submitted by Mrs. Marge Gasch, 1030 . <br /> Tonkawa Road, in the amount of $1,261. 80 and request <br /> staff to submit a resolution for Council approval <br /> at the May 9, 1977 Council meeting. George Johnson, 835 Partenwood Road, noted to the <br /> City Council that Mrs. Parten built her new home on <br /> the old existing site exactly where the old foundation <br /> was. <br />
