John Hacking, representing Victoria Grain Co. , VICTORIA GRAIN COMPANY <br /> stated that his client would favor a conservation 500 North Arm Drive <br /> easement in order to provide a means to retain #200 <br /> �that easement for dock purposes to serve the six lots. <br /> �Mayor Brad Van Nest commented that it should be <br /> noted that we are speaking of one dock from the <br /> _ nainland to the lake or to any portion found to be <br /> navigable water in the future. Mayor Van Nest, <br /> ��' so, noted these comr,ients concerning the <br /> • iservation easement for Outlot B: <br /> l. No dredging. <br /> 2. Dock to cross Outlot B to lake. <br /> .3. The City Council determines that if portion of <br /> Outlot B is navigable waters, the owner of <br /> � Outlot B would retain the right to apply for a <br /> maintenance only dredging permit. <br /> �4. Will serve any part of dry buildable lots to <br /> navigable waters. <br /> �Nir. Shosrom, an attorney representing clients from <br /> �the North Arm area, commented that his clients would <br /> object to any dredging of any form in that area. <br /> Mayor Van Nest noted to Mr. Shosrom that this agree- <br /> ment would be that the applicant could never widen the <br /> channel. Dredging maintenance of that channel is <br /> �something that we would have to address ourselves to <br /> separately, only if the channel is found to have been <br /> �dredged legally with a permit and meeting all conditions <br /> of that permit. <br /> �Mr. John Hacking requested finalizing of the dock <br /> �location with granting of the easement. <br /> `Niayor Van Nest noted to Mr. Hacking that this was <br /> - �reliminary approval for a plat and the City Council <br /> . 1 not received any material from the applicant in <br /> considering a dock approval and that the applicant <br /> �should grant the conservation easement over Outlot B <br /> to preclude dredc�ing and filling with two exceptions: <br /> � (Continued) <br /> r <br />
