P•?otion, Ayes (4) - Nays (0) , <br /> � Dick Benson, City Administrator, stated that the 1976 SEAL COATING PROGRA°.�I <br /> , Plans & Specifications for the 1976 Seal Coating <br /> Program as submitted by the City Engineer, approved <br /> � by the City Council, advertised, and successfully <br /> bid by the Skeets Held Com�any are clear and <br /> � precise, Section 2-35 does define Rejected [�1ork <br /> and PZaterials, and Right of Owner to Terminate <br /> � Contract, After many meetings with various <br /> ! people, prime contractor, subcontractor and <br /> material suppliers, it is evident that the <br /> � contractor cannot supply the correct material. <br /> � The contractor assured us that even though the <br /> material that was desic�nated for Orono° s project <br /> � was used on another project, they ��ould process <br /> . the correct aggregate as specified and complete <br /> Orono's project as originally plannedo On <br /> � August 25, 1976, the contractor was asked if <br /> he in deed hac� read the specifications as submitted <br /> � and if, in fact, felt that he would want to request <br /> an extension of time to complete the contract. <br /> �He rep�lied that he would meet all requirements <br /> of the specifications by August 31, 1976e <br /> � Due to the inability of the contractor to meet <br /> the (1) Original Specifications, (?)
