MINUTES OF THE <br /> ORONO CITY COUNCIL MEETING <br /> Monday March 13,2017 <br /> 7:00 o'clock p.m. <br /> PLANNING DEPARTMENT REPORT—Planning Commission Representative Jon Schwingler <br /> 7&8. #17-3898 DALE RICHARDSON/CBS-MN PROPERTIES,2060 WAYZATA BLVD. <br /> WEST,AMEND PUD NO.2C,AGREEMENT TO ALLOW DAYCARE USE and#17-3899, <br /> JAMES SMALE REPRESENTING LITTLE ACORNS CHILD CARE,INC.,2060 WAYZATA <br /> BOULEVARD WEST,CONDITIONAL USE PERMIT FOR DAYCARE USE <br /> Gaffron stated the applicant is requesting the City amend the zoning provisions for the subject property to <br /> allow `daycare' as an allowed use for the property. In a separate application that will be reviewed this <br /> evening,Little Acorns Childcare has requested a conditional use permit to operate a daycaze in the <br /> existing building on the property. This property is located just west of the Orono senior housing project. <br /> The impetus for this request is the companion application by Little Acorns,which currently operates in <br /> Long Lake. The owners of that business are looking to relocate to this property and operate out of the <br /> existing building on the site. <br /> The property is currently zoned B-6 PUD and is governed by the PUD No. 2C Development Contract as <br /> well as Resolution 5613 that were granted in 2007. The only approved use for the site is a small office <br /> condo complex,which consists of five buildings. To date only one building has been constructed,with <br /> the foundation for the second building being in place. The property remains in a partially developed state <br /> and contains the initial building with three vacant lots. The site grading,parking lot and utilities were <br /> substantially completed by the original developer in 2007-2008. No additional activity has occurred on <br /> the property since approximately 2009. <br /> The Orono Planning Commission at its February meeting voted 6-0 to recommend approval of the <br /> proposed amendment of the PUD No. 2C Agreement to allow `Daycare Use' as a conditional use for the <br /> property, subject to the following additional recommendations: <br /> 1. The amendment is for this property only. <br /> 2. Daycare should not be added as an allowed use in the B-6 District at this time. <br /> 3. The standard 50 square feet of outside play area per pupil that appears in Orono's B-1 and B-3 <br /> conditional use requirements for daycare should not be included in the amendment text since <br /> this standard conflicts with state licensing standards. The applicants should merely be subject to <br /> State licensing standards. It was the recommendation that the provision for 50 square feet of <br /> outside play area appearing in the City's B-1 and B-3 District daycare standards should be <br /> eliminated. <br /> Gaffron stated the applicant is actually proposing roughly 1,500 square feet in one area and another <br /> outdoor play area to the northeast. <br /> Page 6 of 32 <br />
