W MW <br />0 0 <br />z CITY of ORONO <br />1�qti <br />RESOLUTION OF THE CITY COUNCIL <br />\��kESH0 NO. 4 U e� <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBD. 15 (C) AND (D) <br />FILE NO. 42378 <br />WHEREAS, William Z. and Lisa J. Mernik, (hereinafter "the applicants") are <br />the owners of the property located at 1840 Lakeview Terrace within the City of Orono <br />(hereinafter "the City") and legally described as follows: <br />Lot 5, Block 1, "Long Lake Country Club Addition, Henmepin County, ivN" <br />(hereinafter "the property"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Comroissio:i <br />held a public hearing on June 15, 1998, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.03, Subd. 15 (C) and (D) to permit the construction of a fence in the <br />side and rear yards of a through lot to be 4 ft. in height where 3.5' is allowed. <br />Minnesota: <br />NOW, THEREFORE, BE IT -RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application .was reviewed as Zoning File 42378. <br />2. The property is located in the LR -1A, One Family Lakeshore Residential Zoning <br />District where 2 acres is the minimum lot area. The property consists of .994 <br />acres or 43,328 sq. ft. <br />3. The Orono Planning Commission reviewed this application on June 15, 1998 and <br />recommended approval by a vote of 7 to 0. <br />4.
