CZCi70 COUNCIL MEETING OF JANUARY 14, 1975 Page 5 <br /> 2. That the City shall take by right of eminent domain for <br /> �sanitary sewer purposes an easement in the lands described in paragraph <br /> three (3) hereof, and the City Attorney be hereby authorized and directed <br /> to commence proceedings in the District Court of Hennepin County for <br /> appointment of Commissioners to determine the damages, if any sustained <br /> by the respective owners of the parcels affected by such taking, as <br /> authorized by law, and <br /> 3. That the lands referred to above are more particularly <br /> described as follows< <br /> DESCRIPTION OF EASEMENT: <br /> A 20 feet wide permanent easement for sanitary sewer and lift station <br /> purposes over, under, and across Lot 13 Partens Point First Division <br /> according to the plat on file in the Office of the Register of Deeds, <br /> Hennepin County, Minnesota. The center line of said easement is described <br /> as followsa <br /> Commencing at the southwest corner of said Lot 13, thence easterly along <br /> the southerly line thereof 173,0 feet to the point of beginning of the <br /> centerline to be described; thence northerly to a point on the northerly <br /> line of said Lot 13, said point being 154.0 feet easterly of the northwest <br /> corner of said Lot 13 as measured along the northerly line of said Lot 13 <br /> ar.d said center line there terminating excepting therefrom the permanent <br /> structures thereon, And also a permanent easement for sanitary sewer <br /> and lift station purposes over, under, and across the northerly 20 feet <br /> �f said Lot 13 excepting therefrom the permanent structures thereon. <br /> And also an 80 foot wide temporary easement for sanitary sewer and lift " � <br /> station purposes over, under, and across said Lot 13 lying 40 feet on <br /> each side of the above described center line excepting therefrom the <br /> permanent structures thereon. <br /> � And also a temporary easement over, under, and across the northerly 50 feet <br /> of said Lot 13 excepting therefrom the permanent structures thereon. <br /> Said temporary easement expires December 31, 1975. <br /> DESCRIPTION OF EASEMENTs <br /> A 20 foot wide permanent easement for sanitary sewer purposes over, under <br /> � and across Lot 12 Partens Point First Division according to the plat on <br /> file in the Office of the Register of Deeds, Hennepin County, P�Zinnesota. <br /> The center line of said easement is as folloa�s: <br /> Commencing at the southwest corner of said Lot l�,thence easterly->along <br /> the southerly line thereof 122.0 feet to the point of beginning of the <br /> c�nter Zine to be described; thence northerly to a point on the northerly <br /> line of said Lot 12, said point being 148.0 feet easterly of the northwest <br /> corner of said Lot 12 as measured along the northerly line of said Lot 12 <br /> �and said center line there terminating excepting therefrom the permanent <br /> tructures thereon. <br />
