Based on the survey you provided, it looks like the
current location of the stockpile is likely within the 100-year floodplain (or at least partially within). The new survey
should show where the excavated material will be placed above the 100-vear flood elevation (937.6') and how it will be
stabilized/vegetated. Temporary perimeter erosion control along the downhill side of the stockpile should be installed
as soon as possible (e.g. silt fence or biorolls) and maintained until the survey is submitted and the proposed location for
permanent placement of the excavated material is approved. You will be receiving a letter likely by the end of the week
describing the apparent violations and required corrective actions, as well as a deadline for submitting the after-the-fact
permit application and survey. The new survey should be completed and submitted as soon as possible.
I also got your voicemail about the new copy of the survey. If it is the same as the one you gave us on site we won't
need it, but if you would like to swap in case the one we have is the original survey or something that's fine too. I also
checked our database for past permits since you mentioned you thought a MCWD permit was issued to dig the ponds
about 15 years ago, but couldn't find any. If you have any information or documentation that could help us locate a past
permit, please let me know.
Lastly, here is a link to the Minnesota Erosion Control Association's online business directory, which lists some suppliers
where you can buy biorolls (aka sediment logs, biologs, etc.) and other erosion control materials:
http://mnerosion.or/?pae id=88&service=5&subcat=119
Let me know if you have any questions—I'll be in touch.
Catherine Bach
District Technician
Minnehaha Creek Watershed District
18202 Minnetonka Boulevard
Deephaven, MN 55391
Direct: (952) 641-4504
Main Office: (952)471-0590
Fax: 952-471-0682
www.minnehahacreek.or
MIMNEHAHII CltEEK
wwteS+eQ qiSraiCr
i
