IDS, at this time, wished to discuss its two <br /> variance:-requests; one for a 30' variance, and <br /> � the other a variance concerning the 250 versus <br /> the 350 zoning line running from the bank <br /> * building. <br /> '� Massengale moved, Paurus seconded; the vote was Ayes (2), Nays <br /> , ( I ) . ��lary Butler opposed. f4r. Searles abstained. The motion <br /> was to grant no variance on Kelly Avenue side of the IDS <br /> � project <br /> � Searles moved to amend the motion and Butler seconded the <br /> amendment to add to the original motion at this time. The vote <br /> � was Ayes (2), Nays (2), with Paurus and Massengale opposed. <br /> ' Therefore, the motion failed. <br /> � 5. The word enclose was added to this paragraph in <br /> Draft #4 in front of Centeral Garbage Collection <br /> � Area. <br /> 6. Conditions of this item were acceptable to IDS <br /> � as long as we have the understanding that the <br /> Council 's final review and approval is required. <br /> • 7. IDS agreed with these conditions with the same <br /> • understanding as in 6 above. <br /> 8. fDS agreed to the conditions of item #8 in Draft <br /> ! #4 with the uridet'standing that the Council will <br /> approve the final concept whether it be green <br /> � space, berm, br combination ot both. It is to <br /> be understood that a bond will be posted by IDS <br /> � to insure that the maintenance and the clean-up <br /> of the green area willlbe done, whatever it is <br /> � that i s f i na I I y approved. <br /> . 9. Through 16. The cond�fiions which �rere stated in <br /> Draft #4 are agreed to by IDS. <br /> � 17, 18, and 19.
