The configuration of the corner lot places the defined rear yard <br /> adjacent to the neighbor's defined side yard. <br /> b. If Kenwood Way were considered the front, the current defined rear <br /> yard would be considered a side yard where only a 10' setback is <br /> required. <br /> c. The existing rear yard setback of 27 feet at the house and 24.5 feet at <br /> the garage will be maintained and the non-confo�nity will not be <br /> increased. <br /> d. The existing shed �vill be removed decreasing the rear yard <br /> encro achment. <br /> 4. The City Council has considered this application includin� the findings <br /> and recommendation of the Planning Commission, reports by City staff, <br /> comments by the applicant and the public, and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this propei-ty are <br /> peculiar to it and do not apply ;enerally to other property in this zonin; <br /> district; that o anting the variance would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other danger to neighboring <br /> property; would not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicant; and would be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findin�s, the Orono City Council hereby <br /> grants a rear yard setback variance to Orono Municipal Zoning Code Section 78-350 (B) <br /> to allow a renovation consisting of construction of a second story above the existing first <br /> story where the existinj rear yard setback is 27 feet where 30' is required and the <br /> addition of rivo garage stalls at a rear yard setback of 24.5 feet when 30' is required, <br /> subject to the following conditions: <br /> Page ? of� <br />
