City Code section <br /> 78-793 - <br /> Within any 8-6 highway business district, no structure or land shall be used except for one of the following uses or uses <br /> deemed similar by the council: <br /> (1) Offices (business and professional). <br /> (2) Banks and financial institutions. <br /> (3) Libraries. <br /> (4) Motels, and hote/s. <br /> (Code 1984, § 10.45(3); Ord. No. 152 2nd series, §3, 10-28-1996) <br /> Currently schools, daycare centers are only permitted in the R District, with a conditional use permit as follows: <br /> Schools, daycare centers, uses accessory to a high school. <br /> a. Pre-kindergarten, primary and secondary public schools and private schools with a curriculum similar to a <br /> pre-kindergarten, primary or secondary school. Schools may inc/ude before and after school care for <br /> students. <br /> b. Daycare centers, nursery schools and similar programs that are not associated with a public or private <br /> schoo/and serve pre-kindergarten children. <br /> c. Indoor ice arenas accessory to a high school provided the arena, including accessory uses, is: <br /> 1. Located on the same tax parce/ as the high school to which it is accessory and is owned by the <br /> local schoo/district; <br /> 2. Not separated from the high school building by a public road; <br /> 3. Operated by the school district or by a nonprofit organization; and <br /> 4. All structures are located at least 50 feet from any adjacent property zoned for residential use. <br /> Requesting the City Council to change the B-6 zoning to allow a daycare use as an allowed conditional use <br /> would require a zoning code amendment which requires a $700 application fee and a $700 escrow. Attached <br /> is a copy of the Land Use and Conditional Use Permit Application necessary to make this request. <br /> You indicated you'd like to "test the waters" so to speak prior to making an official application...
