Both the proposed new building site and the site with existing <br /> residence are similar in area to other common - ownership lots which <br /> have been approved as building sites since 1984 within the LR-1B <br /> zoning district as fol lows: <br /> Homestead Vacant <br />. Lot Lot <br /> #830 Smiley, 2720 Pheasant Road . 65 .59 <br /> #1051 Glesne, 1475 Cherry Place .68 .64 <br /> #1084 Maxfield, 4175 North Shore Drive . 57 .46 <br /> #1124 Lange, 4160 Forest Lake Drive . 40 . 45. <br /> 8. The lots were created in the early 50's prior to the City's <br /> adoption of ordinances that would have provided standards for the <br /> development of lots. <br /> 9. The applicants have owned the lots for approximately 30 years. <br /> 10. Lot 1 contains no accessory structures and would appear to serve <br /> merely as additional area receiving minimal maintenance. <br /> 11. Glenn Cook, the City Engineer, in a report dated October 6, 1987 <br /> states the following: <br /> Development of Lot 1 on Kelly Avenue will not result in any <br /> • drainage problems for adjacent resident. <br /> The run-off from the neighborhood is currently directed to the <br /> City owned property South of Lot 1. Development of this lot wil 1 <br /> result in additional run-off to the lake because of an increase <br /> in hardcover. We do not anticipate that this increase in run-off <br /> will cause any significant adverse effect on the lake. <br /> 12. The City Council has considered this application incYuding <br /> reports by City staff, comments by the applicant and the effect of the <br /> proposed variances on the health, safety and welfare of the community. <br /> 13. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variances would <br /> not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve <br /> as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a <br /> substantial property right of the applicant; and would be in keeping <br /> with the spirit and intent of the Zoning Code and Comprehensive Plan <br /> of the City.
