ordinances, rules, regulations, and other orders applicable to its activities, operations and <br /> work performed upon, or use of the Easement Area. <br /> Section 4. In exercising its rights and performing its obligations under this <br /> Agreement, Orono agrees to cause, at its sole expense, the Easement Area to be <br /> maintained in a condition substantially equal to that existing upon the completion of the <br /> landscaping over and across the Easement Area as provided in Article 4 below and <br /> pursuant to any and all agreements with the local watershed district and all applicable <br /> laws, ordinances and regulations. <br /> ARTICLE 3 — REPAIR AND MAINTENANCE <br /> Orono shall be responsible, at its own expense, for all repairs and maintenance of <br /> the Improveinents. <br /> ARTICLE 4—RESERVATION OF THE RIGHTS <br /> The Simpsons shall have the right to landscape, including but not limited to <br /> planting grass, tress and slu-ubbery, across and upon the Easement Area and to erect <br /> teinporary barricades as necessary to (i) construct, repair or maintain the landscaping <br /> across and upon the Easement Area, (ii) construct, repair or maintain other portions of the <br /> Simpson Parcel, or (iii) prevent the acquisition of the prescriptive rights by anyone. <br /> ARTICLE 5 —NOTICE <br /> All notices, demands and requests required or permitted to be given under this <br /> Agreeinent must be in writing and shall be deemed to have been properly given or served <br /> either by personal delivery of by depositing the same in the United States Mail, addressed <br /> to the Siinpsons or to Orono, as the case may be, prepaid and registered of certified mail, <br /> return recei�t requested, at the following addresses: <br /> To Simpsons: Charles and Roseanne Simpson <br /> 2695 Kelly Avenue <br /> Excelsior, MN 55331 <br /> To Orono: City of Orono <br /> 2750 Kelley Parkway <br /> PO Box 66 <br /> Crystal Bay, MN 55323 <br /> Rejections or other refusal to accept or the inability to deliver because of changed <br /> address of which no notice was given shall be deemed to be receipt of notice, demand or <br /> request.
