A RESOLUTION GRANTING <br />PRELIMINARY PLAT AND REZONING <br />APPROVAL <br />FOR PROPERTY LOCATED AT <br />2525, 2535, and 2545 SHADYWOOD ROAD <br />FILE NO. 16-3847 <br />WHEREAS, Charles Cudd Co. LLC, a Minnesota limited liability company <br />(hereinafter the "Developer") is the agent for DDK, LLC, a Minnesota limited liability company <br />is the owner of the properties at 2525, 2535, and 2545 Shadywood Road (hereinafter the "Owner") <br />within the City of Orono (hereinafter the "City") and legally described as follows: <br />Lots 1, 2, and 3, Block 1, Leach Addition, Hennepin County, Minnesota <br />(hereinafter the "Property"); and <br />WHEREAS, the Developer has requested Preliminary Plat Approval for <br />development of the Property and rezoning of the property from B-4 (Office/ Professional) and LR - <br />1B (One Family Lakeshore Residential) to RPUD Residential Planned Unit Development District <br />for construction of 7 single-family homes; and <br />WHEREAS, on August 4th, 2016 the Developer completed their application <br />originally filed on June 22, 2016 for comprehensive plan amendment, rezoning, and preliminary <br />plat approval for a 7 -lot residential subdivision of the Property; and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, the Orono Planning <br />Commission held a public hearing for the application and reviewed it on July 18, 2016, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br />WHEREAS, the Planning Commission on Julyl8, 2016 recommended on a vote <br />of 6-0 that the Council approve the rezoning to RPUD Residential Planned Unit Development <br />District; and on a vote of 6-0 that the Council grant preliminary plat approval subject to a number <br />of conditions and recommendations; and <br />WHEREAS, the Orono City Council was given the opportunity to review a sketch <br />plan for the Property at a regular meetings June 2016, and has reviewed the formal application at <br />its regular meeting on August 8, 2016; and <br />WHEREAS, the City Council hereby makes the following findings in regard to <br />Page 1 of 15 <br />
