Council <br />Exhibit G <br />DECLARATION OF COVENANTS, <br />CONDITIONS, RESTRICTIONS AND EASEMENTS <br />THIS DECLARATION IS EXEMPT FROM THE PROVISIONS OF THE MINNESOTA <br />COMMON INTEREST OWNERSHIP ACT, MINNESOTA STATUTES CHAPTER 51511, <br />PURSUANT TO MINNESOTA STATUTES SECTION 51511.1-102 (e) (2). <br />This Declaration of Covenants, Conditions, Restrictions and Easements (this <br />"Declaration") is made this day of , 2016, but effective as provided below, by <br />Chamberlain Capital LLC ("Developer"), a Minnesota limited liability company, and is based on <br />the following facts: <br />A. Developer is the fee owner of real property located in the City of Orono (the <br />"City"), County of Hennepin (the "County"), and State of Minnesota, legally described on <br />Exhibit "A" attached hereto and made a part of this Declaration by this reference (the <br />"Property"). <br />B. Developer intends to subdivide the Property into six (6) residential lots and a <br />single outlot, pursuant to the plat of CRYSTAL BAY ESTATES (the "Plat") <br />C. The City has imposed certain conditions to approving the Plat, including without <br />limitation the condition that Developer obtain necessary permits from the Minnehaha Creek <br />Watershed District. <br />D. The Watershed District has imposed certain conditions to issuing to Developer <br />Permit #15-408 for erosion control, wetland protection and stormwater management (the <br />"Permit") <br />Error!
