A RESOLDTION GRANTING <br /> A CONDITIONAL DSE PERMIT <br /> PER MIINICIPAL ZONING CODE <br /> SECTION 10.23, SUBDIVISION 4 (A) <br /> FILE �1613 <br /> WHEREAS , Jensen Homes Inc. (hereinafter "the <br /> applicant" ) has an interest in the property located at 315 <br /> Tonkawa Road located within the City of Orono (hereinafter <br /> "City" ) and legally described as Tract C, RLS #540 , Hennepin <br /> " County, Minnesota (hereinafter "property") ; and <br /> WHEREAS, the applicant has applied to the City of Orono <br /> for a conditional use permit to permit a non-rental guest <br /> apartment per Municipal Zoning Code Section 10.23, Subdivision 4 <br /> (A) . <br /> NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File �1613. <br /> 2 . The property is located in the LR-lA Lakeshore <br /> Residential Zoning District requiring 2 acres minimum dry <br /> buildable lands. The property consists of 3+ acres in area. <br /> 3. On January 22 , 1991, the Orono Planning Commission <br /> reviewed the application as proposed and recommended <br /> approval based on the following findings: <br /> A) The rural property contains adequate area to meet <br /> the septic needs at a 7 bedroom level use for current <br /> and future needs. <br /> B) The property contains 3+ acres of land where only 2 <br /> acres is required. <br /> C) The applicant has presented a valid need for the <br /> non-rental guest apartment. <br /> D) The interior design and layout of the non-rental <br /> guest apartment within the principal structure <br /> satisfies all pertinent standards of the zoning code. <br /> Paqe 1 of 4 <br />
