_ <br />� <br /> �O� <br /> O O <br /> � � <br /> CITY of ORONO <br /> ti <br /> ��� �G~' RESOLUTION OF TI�E�I�Y�COUNCIL <br /> �'k'E8�rI04 NO. � 7 <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-1288 AND A CONDITIONAL <br /> USE PERMIT PURSUANT TO MUNICIPAL ZONING <br /> CODE SECTION 78-1286 <br /> FILE NO. 07-3284 <br /> WHEREAS, Thomas W. Ritchie and Kristen Ritchie, husband and wife <br /> (hereinafter "the applicants") are the owners of the property located at 2507 Kelly Avenue, <br /> within the City of Orono (hereinafter the"City") and legally described as follows: <br /> Lot 3, Block 1, and Outlot A, Navarre Cove, Hennepin County, Minnesota <br /> (hereinafter the"property"); and <br /> WHEREAS, the applicants have made application to the City of Orono for a <br /> conditional use pernut pursuant to Orono Municipal Zoning Code Section 78-1286 to allow <br /> gading within 75' of the OHWL in order to create a rain garden to manage the on site surface <br /> water drainage; and <br /> WHEREAS, the applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1288 to allow 28.5% hardcover within the <br /> 75' -250' zone where 25% is normally allowed and 30% currently exists in order to construct an <br /> in-gound pooL <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File 07-3284. <br /> 2. The property is located in the LR- 1 B Residential Zoning District which requires <br /> a minimum lot area of 1.0 acre and a minimum lot width of 140'. <br /> Page 1 of 5 <br />
