,�_ , <<. _.. . . <br /> . .; : Ci.ty of ORONO <br /> • <br /> �. <br /> �, . <br /> RESOWTION OF THE CITY COUNCIL <br /> y�. • <br /> � NO. 1575 ' <br /> � 1� RESOLUTION APPROVIIdG THE PLAT OF <br /> � � • • DRAGONFLY HILL <br /> WHEREAS, the City of Orono is a municipal corporation organized and <br /> . existing under the laws of the State of Minnesota ; and <br /> WHEREAS, the City Council of the City of Orono has adopted subdivision <br /> regulations for the orderly, eco.nomic and safe development of land within the <br /> City; and <br /> WHEREAS, the City Council has considered the application for a <br /> subdivision plat of a lot line rearrangement by William D. Gregory II, David J. <br /> Duff , and Edward H. Hamm, the subdividers; and <br /> WHEREAS, the City has asked that the subdividers file separate <br /> application for the vacation of Brackett Avenue in order to resolve all claims of <br /> � interest in the platted right of way and to implement a final plan that would <br /> preserve the public interest and use in the shoreline and roadway; and <br /> WAEREAS, the subdividers have completed all requirements of the <br /> • platting regulations of the City, including : � <br /> 1. Completion of all the requirements of Resolution No . 1482. <br /> 2. Dedication on the plat of drainage and utility easements. <br /> 3. Dedication on the plat of rights of way for public roads, shown as <br /> County Road No . 15 and Orono Orchard Road . <br /> 4. Dedication by quit claim deed by the subdividers of Outlots A and B <br /> to the City in lieu of park dedication fees subject t�o the condition that the <br /> � lakeshore outlots not be used for boat launching purposes and that said outlots <br /> not be transferred,by the City without holding a public hearing to consider such a <br /> transfer , and to the further restriction that no fishing pier or other substantial <br /> . improvements of the like be undertaken without holding a public hearing to <br /> consider the matter. The City further �grees to construct a fence between Outlot <br /> A and Lot l, Block 2 to discourage trespassing . <br /> 5. Dedication by quit claim deed to Hennepin County by each of the <br /> subdividers and the City of Orono deeding a non-exclusive easement for road <br /> maintenance as follows : � <br /> a) Storage of snow plowed from the traveled portion and shoulder of <br /> County Road 15 in the ordinanry cause of keeping said County Road free of <br /> snow; <br /> • b) Ordinary highway maintenance purposes including the right to <br /> maintain support of said County Road 15, to add fill to said easesnent <br /> area , and to trim trees, shrubs and undergrowth; <br />
