i. <br /> 9.4.1 To rrzaintain all portions of the Owner's Unit in good, clean, and sanit • <br /> con ition, and to maintain the Limited Common EIements allocated to the Owner's Un t <br /> to t e extent assigned to the Owner under Section 9.1.1. The Association may require Eh � <br /> the 'i Owners perform their maintenance obligations in accordance with standard <br /> established by the Association. <br /> - 9.42 To per;orri the foregoing maintenance abligations in such manner as n � <br /> to damabe the Property, or unreasonably disturb or cause a hazara to other Persan <br /> . occu�pying or using the Property. <br /> The Association may, with the a�proval of the Members, undertake an <br /> maintenance of a Unit which the responsible Owner fails to or improperly performs, an <br /> � assess the Unit and the Owner for the cost thereof. No such approval shail be necessa <br /> if the Association has the authority under the Governing Documents to perform suc <br /> maintenance. Such cost shall be a personal obligarion of the Owner and a lien against th <br /> Owner's Unit. Owners and Occupants shall promptly notify the Association of defects i <br /> or damage to those parts of the Property which the Association is obligated fo maintai . <br /> The' Board rnay require that the Owners perform their maintenance obligations i <br /> accqrdance with standards established by the Association. <br /> 9.5 Waste of Common Utilities or Commonlv Metered Utilities. An Owner o <br /> Occupant f a Unit shall not cause waste, or unreasonable use, of common utilities or utilitie <br /> that serve t e Unit hut which are commonly metered. In the event the Association determine <br /> that such ste or unreasonable use is occurring, the Association shaIl have the authority to lev <br /> against the',Unit (under Section 6.4, or otherwise), and charge to that Owner; the costs, charge , <br /> and fees (�Nhetfi�er billed by the utility provider, or otherwise) associated with that waste o <br /> unreasonab�e use. Such costs, charges, and fees shall be calculated by the Association usin <br /> reasonable methods. Notwithstanding any provision to the contrary in this Declaration, th <br /> Association may repair or correct any condition (and enter upon any Unit and Limited Commo <br /> Element to do so) causing the waste or unreasonable use. The cost of the repair or correctio <br /> may, at the Boacd's discretion, be assessed against the Unit, and may, at the Board's discretio , <br /> � be the gersona) obligation of the Owner of the Unit and a lien against the Unit <br /> 9.6 Restrictions on Changes to the Propertv. Except as permitted by this Declaratio , ' <br /> no Owner or Occupant shall, without prior written authorization from the Board in accordanc <br /> with Section 7.12: <br /> 9.6.1 Cause or permit any physical or aesthetic changes or alterations, whethe <br /> temporary or permanent; to be made to a Unit or the Common Elements, if such chang <br /> or a�teration is visible from the exterior of his or her Unit. <br /> 9.6.2 Cause or permit any physical changes to his or her Unit or the Commo � <br /> Ele ents that could jeopardize or impair the weather-tight integrity, safety or soundnes <br /> of ny part of the Property, any system or equipment on or within the Property, or an <br /> other improvements located on the Property. <br /> � ' 9.6.3 Interfere with or otherwise impair any easement. <br /> MPLS-Word 95281.1 I 23 <br />
