9.4.1 To maintain all portions of the Owner's Unit in good, clean, and sanitary • I <br /> condition, and to rnaintain the Limited Corrfmon Elements allocated to the Owner's Unit <br /> to the extent assigned to the Owner under Section 9.1.1. The Association may require that � <br /> the Owners perform iheir maintenance obligations in accordance with standards <br /> established by the Associaiion. <br /> 9.�.2 To perforr,i the foregoing maintenance obligatians in such manner as not • <br /> to damage the Property, or unreasonably disturb or cause a hazard to other Persons <br /> . occupying or using the Property. <br /> The Association may, with the a�prova] of the Members, undertake any <br /> maintenance of a Unit which the responsible Owner faiJs to or improperly performs, and <br /> ' assess the Unit and the Owner for the cost thereof. No such approval shall be necessary <br /> if the Association has the authority under the Governing Documents to perform such <br /> maintenance. Such cost shall be a personal obligation of the Owner and a lien against the <br /> Owner's Unit. Owners and Occupants shall promptly notify the Association of defects in <br /> or damage to those parts of the Property which the Association is obligated to maintain. <br /> The Board may require that the Owners perform their maintenance obligations in <br /> accordance with standards established by the Association. <br /> 9.S Waste of Common Utilities or Commonlv Metered Utilities. An Owner or <br /> Occupant of a Umt shall not cause waste, or unreasonable use, of common utilities or utilities <br /> that serve the Unit but which are commonly metered. In the event the Association determines. <br /> that such waste or unreasonable use is occurring, the Association shall have the authority to levy <br /> against the Unit {under Section 6.4, or otherwise}, and charge to that Owner; the costs, charges, <br /> and fees (whether billed by the utility provider, or otherwise) associated with that waste or <br /> unreasonabie use. Such costs, charges, and #'ees shall be calculated by the Association using <br /> � reasonable methods. Notwithstanding any provision to the contrary in this Declaration, the <br /> Association may repair or correct any condition (and enter upon any Unit and Limited Common <br /> Element to do so) causing the waste or unreasor�able use. The cost of the repair or correction <br /> may, at the Board's discretion, be assessed against the Unit, and may, at the Board's discretion, <br /> be the persona! obligation of the Oumer of the Unit and a lien against the Unit <br /> 9.6 Restrictions on ChanQes to the Pronertv. Except as permitted by this Declaration, ' <br /> no Owner or Occupant shall, without prior written suthorization from the Board in accordance <br /> with Section 7.12: <br /> 9.6.1 Cause or permit any physical or aesthetic changes or alterations, whether <br /> temporary or permanent, to be made to a Unit or the Common Elements, if such change <br /> or alteration is visible from the exterior ofhis or her Unit. <br /> 9.6.2 Cause or permit any physical changes to his or her Unit or the Common � <br /> Elements that could jeopardize or impair the weather-tight integrity, safety or so�ndness <br /> of any part of the Property, any system or equipment on or within the Property, or any <br /> other improvements located on the Property. <br /> ' 9.6.3 [nterfere with or otherwise impair any easement. <br /> MPLS-Word 95281.11 23 . <br />
