<br />; 12.13 Restriction on Third Partv Easement Grants. Except for Declarant in the ex rcise
<br /> � of its rights under this Declaraiion, and except for the Boarsi in the exercise of authority gr n#ed
<br /> by the Governing Cocuments, no Person shatl create, grant, or convey any easeme t or
<br /> comparabie rights upon any portion of the Property without the prior written approval f the
<br /> Board;'provided, that the Board shall authorize an Owner to grant an e�sement over the O er's
<br /> Unit if(i) the easement wil] not adversely affect the Common Elements ar another Unit (ii)
<br /> the easement is consisient with the overall design and plan for the Property as establish d by
<br /> Declarant and approved by the City.

<br /> 12.14 Continuation and Scoae of Easements. Notwethstanding anything in this �
<br />. Declar�tian to the contrary, no Owner or Occupant sha11 be denied reasonable access to lpis or
<br /> her UnKt or the right to utility services thereto. The easements set forth in this Section 12+sha11
<br /> supplement and not limit any easements described elsewhere in this Declaration or recorde , and
<br /> shall include reasonabie access to the easement areas through the Units and the Co mon
<br /> Elements for purposes of maintenance, repair, replacement, and reconstruction. All eas ment
<br /> rights shatl include a right of reasonable access to maintain, repair, and replace the utility lines
<br /> and related equipment.
<br /> ', SECTION 13 I
<br /> COMPLIANCE AND REMEDIES
<br /> Each Owner and Occupant, and any other Person owning or acquiring any interest n the
<br /> . Property, shall be governed by and comply with the provisions of the Act, the Gov , ing
<br /> Documents, and the Rules and Regulations, and such amendments thereto as may be made from �
<br /> time to time, and the decisions of the Association_ A failure, to comply shall entitl the �
<br /> Association to the relief set forth in this Section, in addition to the rights and remedies auth rized
<br /> elsewhere by the Goveming Documents and the Act.
<br /> 13.1 Entitlement to Relief. The Association may commence 1ega1 action to re over
<br /> sums due, for damages, for injunctive relief or to foreclose a lien owned by �it, o any .
<br /> combirpation thereof, or an action for any other retief authorized by the Governing Docume ts or
<br /> availal�le at law or in equity, Legal relief may be sought by the Association against any O ner, '
<br /> or by an Owner against the Association or another Owner, to enfarce compliance wi the
<br /> Governing Documents, the Rules and Regulations, the Act, or the decisions af the Associ tion.
<br /> However,no Owner may withhold any Assessments payable to the Association,or take (or mit}
<br /> other action in violation of the Governing Documents,the Rules and Regulations,or the Ac , as a
<br /> measuxe to enforce such Owner's position,or far any other reason.
<br /> 13.2 Remedies. In addition to any other remedies or sanctions, expressed or im lied,
<br /> administrative or legal, the Association shall have the right, but not the obligation, to impl ment
<br /> any one or more of the following actions against Owners and Occupants and/or their guests who
<br /> violate the provisions of the Governing Documents, the Rules and Regutations,or the Act: �
