t T <br /> •Y . <br /> , I <br /> shall be owned, used, occupied, and conveyed subject to the covenants, restrictions, easements, - <br /> charges, and liens set farth herein, ail of which shall be binding upon all Persons owning or <br /> . acquiring any right, title, or interest therein, and their heirs, personal representatives, successors, <br /> and assigns. <br /> � <br /> • SECTION 1 � <br /> � DEFINITdONS <br /> The followin�words when used in the Governing Documents shali have the foilowing meanings <br /> (unless the context indicates otherwise): <br /> l.l "Act" means Minnesota Statutes Chapter S�15B, known as the Minnesota <br /> Common Interest Ownership Act,as amended. � <br /> 1.2 "Assessments" means and refers to all assessments levied by the Association <br /> ' pursuant to Section 6 and pursuant to the Act,including,but not limited to,annual <br /> assessments,special assessments,and limited assessments. <br /> 1.3 "Association" means the Stonebay of Orono Condominium Association, a <br /> nonprofit corporation which has been created pursuant to Minnesota Statutes <br /> • Chapter 317A and Section S15B.3-101 of the Act, whose members consist of al] <br /> Qwners. <br /> � t.4 "Board" means the Board of Directors of the Association as provided for.in the <br /> Bylaws. <br /> 1.5 "Buildin�" means each structure which is or becomes a part of tl�e Property and <br /> which contains at least one Unit. <br /> !.6 "Bvlaws" means the Bylaws governing the operation of the Association, as <br /> amended from time to time. <br /> � 1.7 "Citv"means the city of Orono, Minnesota. <br /> 1.8 "Common Elements" means all parts of the Property except the Units, including <br /> all improvements thereon. <br /> 1.9 "Common Exnenses" means all expenditures made or liabilities incurred by or on <br /> behalf of the Association and incident to its operation, including Assessments and <br /> items otherwise identified as Common Expenses in the Goveming Documents. <br /> 1.10 "Condominium" means the condominium created by this Declaration and known <br /> as Stonebay of Orono Condominium. <br /> 1.11 "Declarant Control Period" means,the time period during which Declarant has the <br /> exclusive right to appoint the members of the Baard, as described in Secrion [6. <br /> MPLS-Wacd 95261.1 I 2 <br />
