<br /> 12.13 Restriction on Third Party Easement Grants. Except for Declarant in the exercise
<br /> � of its rights nder this Declaration, and excegt for the Board in the exercise of authority granted
<br /> by the Gov�rning Docurnents, no Person shall create, grant, or convey any easement or
<br /> comparabie ghts upon any portion of the Property without the prior written approvai of the
<br /> Board;provi�ed, that the Board shal] authorize an Owner to grant an easement over the Owner's
<br /> Unit if(i) th easement will not adversely affect the Common Elements ar another Unit and (ii)
<br /> the easemen�is consistent with the overall design and plan for the Property as established by
<br /> Declarant an�l approved by the City.

<br /> 12.1 Continuation and Scope of Easements. Notwithstanding anything in this '
<br /> Declaration o the contrary, no Owner or Occupant sha11 be denied reasonable access to his or
<br /> her Unit or t e right to utility services thereto. The easements set forth in this Section 12 shal[
<br />: supplement nd not limit any easements described elsewhere in this Declaration or recorded, and
<br /> shall includ reasonable access to the easement areas through the Units and the Common
<br /> Elements fa purposes of maintenance, repair, replacement, and reconstruction. All easement
<br /> rights shatl � clude a right of reasonable access to maintain, repair, and replace the utility lines
<br /> and related quipment.
<br /> SECTION 13
<br /> COMPLIANCE AND REMEDIES �
<br />` Bachl Owner and Occupant, and any other Person owning or acquiring any interest in the
<br />' . Property, st}all be governed by and comply with the provisions of the Act, the Governing
<br />� Documents,land the Ruies and Regulations, and such amendments thereto as may be made fram �
<br />' time to tim , and the decisions of the Association_ A failure. to comply shall entitle the �
<br /> Association to the relief set forth in this Section, in addition to the rights and remedies authorized
<br /> elsewhere b the Goveming Documents and the Act.
<br /> 13.1 Entitlement to Relief. The Association may cornmence legal action to recove
<br /> sums due, for damages, for injunctive relief or to foreclose a lien owned hy �it, or an
<br /> combinatio thereof, or an action for any other retief authorized by the Governing Documents o
<br /> available at�law or in equity, Le�al relief may be sought by the Association against any Owner '
<br /> or by an �wner against the Association or another Owner, to enforce compliance with th
<br /> Governing ocuments, the Rules and Regulations, the Act, or the decisions flf the Association
<br /> However,n Owner may withhold any Assessments payabte to the Association, or take(or omit
<br /> other action�in violation of the Governing Documents,the Rules and Regulations,or the Act,as
<br /> measure to nforce such Owner's position,or for any other reason.
<br /> 13.� Remedies. In addition to any other remedies or sanctions, expressed or implied
<br /> administrat ve or legal, the Association shall have the right, but not the obligation, to implemen�
<br /> any one or ore of the following actions against Owners and Occupants and/or their guests,wh
<br /> violate the rovisions of the Governing Documents,the Rutes and Regulations, or the Act: '
