Subject to Declarant's rights under Seetion, the <br /> written onsent of Eligible Mortgagees representing at leasT sixty-seven percent of the Units that <br /> are sub ect to first mortgages held by Eligible Mortgagees {based upon one vote per nit <br /> finance ) shall be required to (i) abandon or terminate the Condominium; (ii) change the <br /> allocati ns of voting rights,Common Expense obiigations or interests in the Common Elem nts; <br /> (iii) pa ition or subdivide a Unit except as permitted by statute; {iv) abandon, parti ion, <br /> subdivi e, encumber, or sell any Common Elements; or {v) use hazard insurance proceed for <br /> other th n the repair,replacement or reconstruction of the Property,except as otherwise prov ded <br /> by law. <br /> 153 Consent to Subdivision.
