The property is located in the LR-1A zonindistrict and within Tier 2 of the Stormwater Quality Overylay
District. Hardcover Information packet attached.
Attached is a partial copy of a survey on file from 1998. No structures can be located within the drainage easement,
outlined in orange. There is not setback from the easement;there appears to be wetlands on the property, these may
or may not coincide with the easement. A wetland delineation must be completed to know the exact location of the
edge of the wetland. A structure (either attached or detached) must be setback 35'from the delineated edge.
The front(street side) setback is 50', measured from the property boundary. Constructing an addition, attached to the
house (between the house and the road) must be set back 50', no closer to the street than the green line on the
attached partial survey. Additions to the other sides of the house would be dependent upon the 35' setback from the
wetland and/or outside of the drainage easement.
According to City Code Section 78-1435, a detached structure cannot be placed forward of the principal structure
(between the house and the road). If this location is of interest to you, you would have to request a variance and state
your practical difficult as to why the structure is needed in that location. A Variance requires a $700 application fee, a
public hearing at a Planning Commission meeting and then is heard at a Council Meeting. The variance process can take
6-8 weeks. Attached is a copy of the Variance Application. If you are interested in pursuing a variance, a wetland
delineation is still required. Contact me and I can schedule a meeting with a City Planner.
Christine Mattson
Planning Assistant
City of Orono
2750 Kelley Parkway ; Orono ; MN 55356 (physical addressJ
PO Box 66 ; Crystal Bay ; MN : 55323-0066 (mailing addressJ
' 952.249.4620 8 952.249.4616
 cmattson@ci.orono.mn.us 'f www.ci.orono.mn.us
Office Hours: Monday- Friday 8 am to 4:30 pm
1
