�°� <br /> 0 0 <br /> CITY of ORONO <br /> a s ''a' <br /> h <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`9k'Esi3�g'�G NO. 5 7 7 2 <br /> to preserve a substantial Property right of the Applicants; and would be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> , grants variances to Qrono Municipal Zoning Code $ecfion 78-1288 in order to permit <br /> 60f square feet or 0.8% hardcover consisting entirely of an allowed lake access stair <br /> within the 0-75' zone where 0% is normally allowed and 13.6% previously existed; and <br /> 4,665 s.f. or 29.8%hardcover within the 75' —250' zone where 25% is normally allowed <br /> and 5,376 s.f. or 34.5% currently exists; and a conditional use permit pursuant to Orono <br /> Municipal Zoning Code Section 78-1286 to allow re-grading of the slope within the 0-75' <br /> zone after wooden retaining walls, a wooden lake access stair and lakeside deck are <br /> removed in conjunction with the construction of a new single family home on the existing <br /> lot, subj ect to the following conditions: � <br /> 1. Council approval is based on the site plan, building plans and stormwater <br /> infiltration and percolation system plan submitted by the Applicants and <br /> annotated by City staff, attached to this Resolution as Exhibits A, B, and C. Any <br /> amendments to the site plan and building plans which are not in conformity with <br /> City codes will require further Planning Commission and City Council review. <br /> 2. The water infiltration and percolation system design shall be submitted for <br /> approval by the City Engineer prior to issuance of a building permit. <br /> 3. ADDITIONAL SURVEYS REQUIRED: <br /> a. A foundation survey is required to be submitted prior to commencement <br /> of framing; and <br /> b. An as-built grading plan verifying compliance with the building permit, <br /> stormwater management, grading and drainage plans shall be submitted <br /> . prior to the issuance of�a Certificate of Occupancy for the residence. <br /> 4. The building plans submitted for building .permit will be reviewed to ensure <br /> compliance with the City's building height and number of stories regulations. <br /> �� 5. Hardcover in the 0-75' zone shall be limited to 60f square feet or 0.8% hardcover <br /> consisting entirely of an allowed lake access stair; and hardcover within the 75'- <br /> Page 3 of 5 <br />
