� � R � Sec.13.04 RIGIiTS OF SLJB.TECTS OF D:�TA Subd. 1. Type of data. Ihe righrs of individual on whom the data is stored or to be scored shall be as set for[h in this secdon. Subd.2. Information reqtrired to be given individual. An individual asked ro supply private or confideadal dara concerning himself shall be informed of: (a)the purpose and inunded use of the requesud data wichin[he collecang�tate agency, polidcal subdivision,or statewide sy5tem; (b)whether he may refuse or is legally required to supply the requested dara:(c)any lrnown coasequence arising from his supplying or refusing to supply� : • privace or confidendal dan:and(d)the idendry of ocher peaoas or enddes aachorized by state or federal iaw to receive che dara. Subd.3. Access to data by individual. Upon request to a responsible au[horiry,an individual shall be informed whethet he is the subject of scored data on individuals,and whecher it is classified as public, private or confidenrial. Upon his funhec request,an individuai who is the subjecc of stored privace or public data on individuals shall be shown che daca wi�hout any charge to him and;if he desires,shall be informed of the concent and meaning of chat dara. Aher an individual has been shown the priva�e data and informed of iu meaniag,the data need not be disclosed to him for six mon[hs thereaccer unless a dispute or acdon pursuan�to this secdon is pending or addiaonal data on the individual has been collected or creamd. The respansible auchoriry shall provide copies of the privau or public dara upon request by the individual subject of che daca. The responsible authority may require che«quesring person to pay the acmal coscs of making,cerdfying,and compiling the copies. The responsible authoriry shall comply immedia�ely,if possibte,wich any requesc made pursuant to ehis subdivision,or wirhin five days of the dace of the requesc,exctuding Sacurdays,Sundays and legal holidays,if immediate compiiance is not possible. If he cannot comply with the request wirhin[hac ame,he shail so inform ehe individual,and may have an addiaonal five days wirhin which to comply wi�h the request,excluding Saturdays, Sundays and legai holidays. Subd.4. Procedure whea data is not accurate or complete. An individual may contest the accuracy or completeneu of public or private dara concerning himself. To exercise chis righc,an individual shal!nodfy in wriang the responsible auehoriry describing the nacure of the disagreemeac. The responsible auchoriry shall within 30 days either: (a)correct the data found to be inaccurate or incompiece and attempt to nodfy pasc recipients of inaccunce or incomplete dara,inciuding recipiencs named by�he individual;or(b)noafy the individual thac he believes[he daca to be cocrecG Data in dispuce shall be disclosed oniy if ehe individual's statemenc of disagreement is included wirh the disclosed data. The decerminarion of the responsibte au�horiry may be appealed pursuant to the provisions of the adminisaarive procedure act relaring to contested cases.
