I spoke with Mrs. Bazil who indicated the stairs and deck had not been altered. <br /> She said they thought they didn't need to make changes since the water board (sic) had <br /> said they were OK. Mr. Bazil was out of town for the rest of the week. I asked her to <br /> have him call me when he returned. He has not called. <br /> Notices <br /> On October 9, 2007, Lyle Oman sent the Bazils a letter informing them that the work <br /> they had done required a permit and would have to be modified to comply with the <br /> code. A copy of this letter is attached. <br /> On December 4, 2007, I sent Mr. Bazil a letter indicating that only a four foot wide <br /> section running the depth of the dock could be retained and setting a June 1, 2008 <br /> deadline for bring the stairs and deck into compliance. A copy of this letter is attached. <br /> On January 30, 2009, I sent Mr. Bazil a letter reminding him of the need to obtain a <br /> permit and indicating he could retain a four foot wide section running the length of the <br /> deck. I specified a June 1 deadline for completing the work. A copy of this letter is <br /> attached. <br /> Desired Outcomes <br /> Property owner obtains a permit for the stairs and boardwalk and modifies them to <br /> comply with code. <br /> Violations <br /> Sec. 78-1282. Stairways, lifts and landings. <br /> Stairways and lifts are the preferred alternative to major topographic alterations for <br /> achieving access up and down bluffs and steep slopes to shore areas. Stairways, lifts <br /> and landings shall be allowed in the shore setback zone and must meet the following <br /> design requirements: <br /> (1) Stairways and lifts must not exceed four feet in width. <br /> (2) Landings for stairways and lifts shall not exceed 32 square feet in area. <br /> (3) Canopies or roofs are not allowed on stairways, lifts, or landings. <br /> (4) Stairways, lifts and landings may be either constructed above the ground on <br /> posts or pilings or placed into the ground, provided they are designed and built in <br /> a manner that ensures control of soil erosion. <br /> (5) Stairways, lifts and landings must be located in the most visually <br /> inconspicuous portions of lots, as viewed from the surface of the public water, <br /> assuming summer, leaf-on conditions, whenever practical. <br /> (6) Facilities necessary to provide shore area access to physically handicapped <br /> persons shall be allowed, provided that the dimensional and perFormance <br /> standards of subsections (1)--(5) of this section are completed in addition to the <br />
