, Sec.13.04 RIGHTS OF S[JB.T�CTS OF DATA Subd. 1. Type of data. The rights of individual oa whom the dara is stored or to be sto�ed shail be as set forth in rtus secaon. Subd.2. Information required to be givea individual. An individual asked to supply private or co�dential data concerning himself shall be informed of: (a)the purpose and incended use of the requested data within the collecdng'state agency,polidcal subdivision,or sratewide system; (b)whether he may refuse or is legally roquired to supply the requested data;(c)any known consequence arising from his supplying or refusing to supply private or confidenaal data;and(d)rhe idenury of other persons or endries authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to supply invesdgaave daca, pursuan[to section 13.82, subdivision 5, to a law enforcement officer. The commissioner of revenue mav place the nodce required under this subdivision in the individual income tax or aroaertv tax reCund instcucrions instead of on those forms. Subd.3. Access to data by individual. Upon request to a responsibie authoriry,an individual shall be informed whether he is the subject of stored data on individuals,and whecher it is classified as public, private or co�dential. Upon his furrher request,an individual who is the subject of stored private or public dara on individuals shall be shown the data wirhout any,charge to him and;if he desues, shall be informed of the contenc and meaning of that dara. After an individual has been shown the priva[e data and informed of ics meaning,the data need not be disciosed to him for six months t}iereafter unless a dispute or action pursuant to this section is pending or additional data on the individual 6as been collected or crea[ed. The responsible.authoriry shall provide copies of the private or pubiic data upon request by the individual subject of the data. The responsible au[horiry may require the requesring pe�son to pay the actual coscs of making, certify'►ng,and compiling the copies. The responsible authoriry shall comply immedia[ely,if possible,with any request made pursuant to this subdivision,or within five days of the date of the request,excluding Samrdays,Sundays and legal holidays,if immediate compiiance is not possible. If he cannot compiy with the reques[ within that time,he shall so inform the individual,and may have an addidonal five days within which to comply with[he request,excluding Saturdays, Sundays and legal holidays. Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public oc private data concerning himself. To exercise this right,an individual shall norify in wriring the rosponsible authoriry describing the nature of the disagreemenc. The responsible authoriry shail within 30 days either: (a)correcc the data found to be inaccurate or incomplete and aaempt to nodfy past recipients of inaccurate or incomp(ete data, inciuding recipients named by the individual;or(b)noafy the individual thac he believes the data to be coaect. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The determinarion of the responsible authoriry may be appealed pursuant to[he provisions of the administraave procedure act relaang to contested cases.
